The U.S. Department of Commerce has approved a broad rollout of OpenAI’s GPT-5.6 model family, according to Axios, which cited a person familiar with the matter. OpenAI expects a wide release this week following additional testing and meetings with government officials. The clearance ends a five-week standoff in which the world’s most closely watched AI company could not release its own flagship model without federal sign-off.


That delay was unusual. OpenAI said last month it was holding back GPT-5.6’s public launch at the government’s request, limiting access to a small group of vetted partners whose identities were shared with authorities. A private company waiting on a government green light before shipping a product is not how the AI industry has operated until now, and the precedent set this week will likely outlast this particular release.

From Delay to Deployment

OpenAI first introduced Sol, Terra, and Luna on June 26, but only for a limited preview restricted to roughly 20 trusted partner organizations approved by the U.S. government. That restriction traced back to an executive order requiring AI companies to share advanced models with the government for capability assessment before choosing which partners receive early access.


Sol drew particular scrutiny because of its coding and cybersecurity capabilities. OpenAI describes Sol as stronger at identifying and fixing software vulnerabilities than at reliably executing full cyberattacks, and the company says the model does not cross its internal “Cyber Critical” threshold. OpenAI has also acknowledged that benchmark testing cannot account for every way a model might behave once combined with other tools, a caveat that speaks directly to why the review took as long as it did.


The testing itself was conducted by the Commerce Department’s Center for AI Standards and Innovation. OpenAI sent technical staff to Washington to work through the agency’s questions directly, rather than handling the review remotely. Once that process concluded without objection, the government cleared the broader release.

A New Family of Models

GPT-5.6 ships as three distinct models rather than a single flagship. Sol is the top tier, built for the hardest reasoning, coding, and agentic workloads. Terra is positioned as the balanced option for everyday professional use. Luna is the lower-cost tier aimed at high-throughput scripting and simpler tasks.


Independent benchmark tracking puts Sol Ultra at 91.9% on Terminal-Bench 2.1, a test that measures multi-step command-line reasoning and tool coordination. Terra matches the performance of OpenAI’s current public flagship, GPT-5.5, at roughly half the price. Luna scores 82.5% on the same benchmark at a fraction of Sol’s input cost. The pricing spread mirrors the capability spread: Sol commands premium rates, Luna is built for volume.


Splitting a release into tiers is not new for OpenAI. What is new is that the tiering happened to align with the government’s review process, since the more capable a model, the more scrutiny it invited before reaching partners outside the initial approved list.

Washington’s Growing Role in AI

Frontier AI development has historically operated under voluntary safety commitments and self-reported testing. The executive order behind GPT-5.6’s staggered release inserts a formal government review step between a lab finishing training and a customer gaining access, a structural change that did not exist a year earlier.


OpenAI has publicly pushed back on the arrangement becoming permanent. The company said government approval “should not be the long-term default,” arguing the process keeps useful tools out of the hands of users, developers, enterprises, cyber defenders, and international partners who need them. A company stating this so directly about a process it just completed suggests OpenAI views the review as a one-time cost rather than a template it wants to repeat.


There is also a financial dimension to the relationship. Sam Altman has proposed a 5% equity stake for the U.S. government, an idea he has reportedly discussed with senior officials, including the Treasury and Commerce Secretaries, since the start of the current administration. President Trump has signaled openness to arrangements where “the American public essentially becomes a partner.” Set against that backdrop, the GPT-5.6 review looks less like an isolated security check and more like an early data point in a deepening relationship between Washington and frontier AI developers.

Competition Doesn’t Pause

OpenAI’s review period did not slow its rivals. Anthropic launched Claude Sonnet 5 as its new consumer default after Claude Fable 5 was suspended in mid-June under U.S. export controls tied to national security concerns. Sonnet 5 now scores higher than Anthropic’s own Opus 4.8 on Terminal-Bench 2.1 while costing significantly less to run. Fable 5 returned to global availability on July 1 once those export restrictions were lifted, meaning Anthropic navigated its own government-driven suspension during the same window OpenAI spent waiting on approval.


Google has continued advancing Gemini 3.1 Pro, which retains an edge in long-context reasoning and research-heavy tasks. The Artificial Analysis Intelligence Index has shown OpenAI, Anthropic, and Google trading the top ranking every few weeks throughout 2026, reflecting how quickly relative standings shift with each release. xAI confirmed on June 28 that Grok 4.5 is running in private beta on a new architecture with roughly 1.5 trillion parameters, though no public release date has been set. Meta’s frontier model efforts have drawn less attention recently, with the company’s public focus weighted more toward open infrastructure than headline model launches.


GPT-5.6’s approval resets these comparisons rather than settling them. For several weeks, Sonnet 5 and Gemini 3.1 Pro were the models actually available for public benchmarking, since Sol remained gated. Once Sol reaches broader availability, direct comparisons with Anthropic and Google’s current models become possible again, and given the pace of releases this year, another shift is likely within weeks.

The Next Phase of OpenAI

Government approval does not mean immediate universal access. GPT-5.6 remains available only through the API and Codex for approved partners, with ChatGPT integration planned for a later stage of the rollout. Enterprises already running pilots through Codex are positioned to gain full access first, since they have held partner-tier credentials throughout the preview period.


Consumer ChatGPT users face a longer wait. Developers building on the API stand to benefit soonest once Sol, Terra, and Luna extend beyond the vetted partner list, since agentic coding and long-horizon task execution are where this model family is designed to differentiate itself from GPT-5.5. OpenAI is likely to widen access incrementally rather than all at once, both for infrastructure reasons and because a second regulatory misstep would carry real reputational cost at this stage.

OpenAI’s review moved faster than Anthropic’s export-control suspension did, but the underlying mechanism is the same in both cases a federal agency, not just the lab itself, now has a say in when and to whom the most capable models become available.


What happens next will tell the industry more than this week’s approval does. A smooth extension of GPT-5.6 into ChatGPT and the public API would suggest other labs can expect a similar, bounded review process for their own frontier releases. A stall, or a new restriction introduced later, would suggest Washington intends to keep a more permanent hand on the release calendar for advanced AI. Either outcome will shape how the next generation of models reaches the public.
